A Delhi court on Tuesday filed a case against Jawaharlal Nehru University (JNU) alumnus Umar Khalid and JNU student Sharjeel Imam in a case related to riots in North East Delhi (Delhi Violence). Took cognizance on the charge sheet. The court decided to proceed against the offenses under the Strict Unlawful Activities (Prevention) Act (UAPA) against them, but did not take cognizance of treason, criminal conspiracy and some other charges under the Indian Penal Code as necessary clearance is awaited. Delhi Police has stated in its charge sheet that Sharjeel was combined with the religious fanaticism of the Imam, his educational heritage and sharp oratory skills, for which the Imam’s Guru Omar Khalid was looking for an opportunity.
In the charge sheet filed on Sunday, Sharjeel Imam and Khalid have been charged under the provisions of UAPA, IPC, arms law and the Prevention of Damage to Public Property Act. Additional Sessions Judge Amitabh Rawat said that there is enough material to proceed against the accused Imam, Khalid and Faizan Khan. The court took cognizance of the charges under Section 13 (unlawful activities), Section 16 (terrorist law), Section 17 (raising funds for terrorist acts), Section 18 (conspiracy) of UAPA.

He has been charged under sections 147 and 148 (rioting), section 149 (illegal gathering), section 186 (instructing public servant), section 201 (disappearance of evidence) of Indian Penal Code. The court, however, under Section 124A (sedition), Section 153-A (promoting bitterness on the basis of religion, language, caste etc.), Section 109 (hatred) and Section 120-B (criminal conspiracy) of the Indian Penal Code. Did not take cognizance of the allegations. Necessary approval in this regard is still awaited.

The court said in its order that after considering the charge sheet and the attached documents, there are sufficient materials for the proceedings against the accused Sharijil Imam, Omar Khalid, Faizan Khan. The next hearing in the case will be held on 22 December.
