Here every person has the freedom to speak and as the Supreme Court we are there to protect ‘free speech’. The constitution of the Supreme Court has been made because of the fact that it can be ensured that ordinary citizens are not tortured ‘.
FIR was filed, in fact, Delhi resident Roshni Biswas was summoned by the Kolkata Police for the alleged objectionable Facebook post. The woman targeted the Mamata government for violating lockdown rules by sharing a picture of Kolkata’s crowded Raja Bazar amid the Corona epidemic. After this, the police had also registered an FIR against Roshni for spreading hatred about the particular community.
This a dangerous trend court rebuked the police and the government, saying that if the police of the states start issuing summons to the common people in this way, then it will become a dangerous trend. In such a case, the courts will have to go ahead and protect the right to freedom of expression, which is available to every citizen under Section 19 (1) A of the Constitution.
High Court order reversed
Earlier, the Calcutta High Court, hearing the case, ordered Roshni to appear before the police. The victim filed a petition in the Supreme Court against this decision. The Supreme Court objected to the police summons saying that summoning the woman from Delhi to Kolkata is like disturbing. Tomorrow the police of other states can also do this, it is a dangerous trend.
During the hearing of the encroachment case on freedom of speech, the state government insisted that the woman should appear before the police, she would not be arrested. On this, the Supreme Court made a sharp comment and said that it looks like you want to tell the woman how dare you write against the government. The bench further said that ‘citizens of the country cannot be rotated from one place to another with the post criticizing the government. It is like an encroachment on the freedom of speech of the citizen’.
